SCOPE OF APPLICATION

These General Terms and Conditions (GTC) apply to all deliveries from the HAN Webshop (hereinafter HAN Shop) to consumers. A consumer is any natural person who enters into a legal transaction for a purpose that is predominantly neither commercial nor self-employed.

CONTRACTUAL PARTNER

The purchase contract is concluded with HAN GmbH & Co. KG, Daimlerstr. 2, 32051 Herford, Commercial Register: Bad Oeynhausen Registry Court, HRA 4053 and HRB 5839.

CONCLUSION OF CONTRACT

The presentation of the products in the HAN Shop does not constitute a legally binding offer, but only an invitation to order. By clicking the button [Kostenpflichtig bestellen] you place a binding order for the goods listed on the order page. Your purchase contract is concluded when we accept your order by sending an order confirmation by e-mail immediately after receiving your order.

RIGHT OF WITHDRAWAL

If you are a consumer (i.e. a natural person who places the order for a purpose that cannot be attributed to your commercial or independent professional activity), you have a right of withdrawal in accordance with the statutory provisions. If you make use of your right of withdrawal as a consumer, the regulations set out below apply to the right of withdrawal.

RIGHT OF WITHDRAWAL

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods. In the case of a contract for several goods which you have ordered as part of a single order and which are delivered separately, the deadline is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken or has taken possession of the last goods.

To exercise the right to cancel, you must inform us, HAN GmbH & Co KG, Daimlerstr. 2, 32051 Herford, Tel.: +49 (0)5221 933 7733, E-Mail: shop@han-online.com of your decision to cancel this contract by a clear statement (e.g. e-mail). For this purpose, you can use the model withdrawal form provided for download on our website or another clear declaration. If you make use of this option, we will immediately send you a confirmation of receipt of such a revocation and a returns label. In order to comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

CONSEQUENCES OF REVOCATION

If you withdraw from the contract, we must refund the full purchase price to you immediately and at the latest within fourteen days from the day on which we receive notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction. We may refuse to make the repayment until we have received the goods back.

You must return or hand over the goods to us immediately and in any case no later than within fourteen days from the day on which you notify us of the revocation of this contract. The deadline is met if you send the goods before the deadline of fourteen days. Please request a returns label using the contact details above. You only have to pay for any loss of value of the goods if this loss of value is due to the handling of the goods which is not necessary for the inspection of the condition, properties and functioning of the goods.

PRICES AND SHIPPING COSTS

The prices stated on the product pages include the statutory value added tax and other price components. In addition to the prices quoted, we charge a flat rate of €4.95 gross per order for delivery within Germany. The shipping costs will be clearly communicated to you again in the shopping cart system and on the order page.

DELIVERY

Delivery only takes place within Germany with our parcel shipping service providers. The delivery time is up to 5 working days. We will inform you of any deviating delivery times when you place your order.

PAYMENT

Payment is made in advance via the payment methods offered by our payment service provider (Mollie, www.mollie.de ) (PayPal, credit card, instant bank transfer).

RESERVATION OF TITLE

Until full payment, the goods remain our property.

DISPUTE RESOLUTION

The EU Commission has created an Internet platform for online dispute resolution. The platform serves as a contact point for the out-of-court settlement of disputes concerning contractual obligations arising from online purchase contracts. Further information is available at the following link: www.ec.europa.eu/consumers/odr. We are willing to participate in a dispute resolution procedure before a consumer arbitration board for the settlement of disputes with consumers. The competent consumer arbitration board is: Universalschlichtungsstelle des Bundes Zentrum für Schlichtung e.V., Straßburger Straße 8, 77694 Kehl am Rhein www.universalschlichtungsstelle.de. In order to resolve the aforementioned disputes, we will participate in a dispute resolution procedure before this body.

(1) These General Terms and Conditions (GTC) shall apply to all contracts concluded between HAN GmbH & Co KG, Daimlerstr. 2, 32051 Herford, Germany, E-Mail: shop@han-online.com (hereinafter referred to as “Seller”) and consumers (hereinafter referred to as “Customer”) via the Seller’s online store. (2) A consumer within the meaning of Section 13 BGB is any natural person who enters into a legal transaction for purposes that are predominantly outside his or her sphere of competence.

2. conclusion of contract

(1) The presentation of the products in the online store does not constitute a legally binding offer, but an invitation to place an order. (2) By clicking on the “Place order” button, the customer submits a binding offer to conclude a purchase contract. The contract is concluded when the seller accepts the order by sending an order confirmation by e-mail.

3. prices and terms of payment

(1) All prices are final prices in euros and include statutory VAT. (2) Payment is processed via the payment service provider Mollie. Mollie’s terms of use, which are specified in the order process, apply.

4 Delivery, shipping and retention of title

(1) Delivery is made by DHL to the delivery address specified by the customer. The delivery time is up to 5 working days after receipt of payment, unless otherwise stated in the offer. (2) The goods remain the property of the seller until the purchase price has been paid in full.

5. right of withdrawal

(1) Consumers have a statutory right of withdrawal in accordance with the following conditions.

Consequences of the revocation

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you.

8 Applicable law

The law of the Federal Republic of Germany shall apply. Mandatory provisions of the law of the country in which the customer has his habitual residence shall remain unaffected.

9. dispute resolution

The EU Commission provides a platform for online dispute resolution (OS), which you can find at https://ec.europa.eu/consumers/odr/. The seller is not obliged to participate in a dispute resolution procedure before a consumer arbitration board.

10. final provisions

Should any provision of these GTC be invalid, the remainder of the contract shall remain valid. The relevant statutory provisions shall apply in place of the invalid provision.
